OR MISUSE OF THIS PRODUCT, INCLUDING, BUT NOT LIMITED TO, PERSONAL
INJURY, DAMAGE TO PROPERTY, LOSS OF BUSINESS, LOSS OF INCOME,
SPECIAL DAMAGES, INCIDENTAL DAMAGES, CONSEQUENTIAL DAMAGES,
PUNITIVE DAMAGES, OR EXEMPLARY DAMAGES, WHETHER FORESEEABLE
OR UNFORESEEABLE. IN NO EVENT WILL SmileyPAT LLC’S LIABILITY EXCEED
THE VALUE OF THE PRODUCT(S) SOLD.
YOU UNDERSTAND AND AGREE THAT THE PRODUCT’S PERFORMANCE
MAY VARY DEPENDING ON THE WASHING MACHINE OR DRYER USED
WITH THE PRODUCT, RESULTING IN POSSIBLE HARM OR DAMAGE TO
THE WASHING MACHINE OR DRYER, E.G., THE DOOR BEING MISALIGNED.
YOU ARE RESPONSIBLE TO CHECK THE SUITABILITY OF YOUR WASHING
MACHINE OR DRYER FOR USE WITH THE PRODUCT. YOU FULLY ACCEPT AND
ASSUME ALL SUCH RISKS AND ALL RESPONSIBILITIES FOR LOSSES, COSTS,
AND DAMAGES THAT YOU MAY INCUR AS A RESULT OF YOUR USE OF THE
PRODUCT IN CONNECTION WITH YOUR WASHING MACHINE OR DRYER.
This product liability disclaimer states the entire obligation of SmileyPAT LLC with
respect to the product(s). If any part of this disclaimer is determined to be void,
invalid, unenforceable or illegal, including, but not limited to the warranty disclaimers
and liability disclaimers and liability limitations set forth above, then the invalid or
unenforceable provision will be deemed superseded by a valid, enforceable provision
that most closely matches the intent of the original provision and the remainder of the
agreement shall remain in full force and effect.
